ABOUT THESE TERMS

This website and online store are operated by Jos Pieczka. Throughout these Terms, “we”, “us” and “our” refer to Jos Pieczka.

These Terms apply when you visit jospieczka.com or purchase from our online store. By using the website or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.

PRODUCTS AND ARTWORK

We make reasonable efforts to describe and display each artwork accurately. Colours and details may appear slightly different depending on your screen, lighting and display settings. Minor variations may also occur during printing. These variations do not affect any rights you have under applicable consumer-protection laws.

Measurements and paper specifications are provided in each product description. Please check the artwork, size and delivery details carefully before ordering.

All artwork, images, written material and other original content on this website remain the intellectual property of Jos Pieczka or their respective rights holders. Purchasing a print gives you ownership of that physical print. It does not transfer copyright or grant permission to reproduce, modify, distribute or commercially use the artwork.

ORDERS AND PAYMENT

You must be legally able to enter into a purchase contract or have permission from a parent or guardian.

When placing an order, you agree to provide accurate and complete contact, billing and delivery information. Please check your order carefully before submitting it.

An order confirmation means that we have received your order. We may cancel and refund an order if we cannot fulfil it, if payment is not authorised, if fraud is reasonably suspected, or if there is a genuine and obvious pricing or technical error. If we cancel an order after payment, we will issue a full refund.

Prices, delivery charges and any applicable taxes will be shown before payment. The currency displayed at checkout applies to your order.

Promotions or discount offers may have additional conditions. Those conditions will be displayed with the relevant offer.

MADE-TO-ORDER PRODUCTION

Our art prints are made especially for each order. We use Prodigi and its production and fulfilment partners to print and dispatch orders. Where possible, orders may be produced closer to the delivery destination.

Production begins shortly after an order is placed. Changes or cancellations may only be possible before production begins. Please contact us as soon as possible at contact@jospieczka.com if you need to request a change.

Different print sizes may be produced or packaged separately and can arrive in separate deliveries.

SHIPPING

Production and delivery timeframes are estimates rather than guaranteed delivery dates. Delivery can be affected by customs processing, postal disruptions, severe weather, remote locations and other circumstances outside our reasonable control.

Available delivery options, charges and estimated timeframes are explained in our Shipping Policy and displayed at checkout.

International orders may be subject to customs duties, import taxes or other local charges. Unless collected at checkout or stated otherwise, these charges are the recipient’s responsibility.

RETURNS, REFUNDS AND CONSUMER RIGHTS

Because our prints are made to order, we do not ordinarily accept returns, refunds or exchanges for change of mind, an incorrectly selected size, or a decision that the item is no longer wanted.

If an item arrives damaged, faulty, incorrect or materially different from its description, please contact us promptly at contact@jospieczka.com. Our Return and Refund Policy explains what information to provide and how we will assess the issue.

Nothing in these Terms or our other policies excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, including rights under the Australian Consumer Law.

WEBSITE USE

You must not use this website:

• for unlawful or fraudulent purposes
• to infringe another person’s rights
• to transmit malicious code or interfere with the website’s operation or security
• to copy, reproduce or commercially exploit our artwork or content without permission
• to submit false, misleading or abusive material

We may restrict access where reasonably necessary to protect the website, our business, our customers or other users.

THIRD-PARTY SERVICES

Our store is hosted by Shopify. Payments, printing, fulfilment and delivery may be provided by third-party services, including payment providers, Prodigi and postal or courier services.

Although these services help us fulfil your order, your purchase remains with Jos Pieczka, and you should contact us first if there is a problem.

This website may contain links to third-party websites. We are not responsible for the content, security or privacy practices of websites we do not control.

PRIVACY

We handle personal information in accordance with our Privacy Policy. Information necessary to process, produce, pay for and deliver an order may be shared with Shopify, payment providers, Prodigi and delivery providers.

WEBSITE INFORMATION AND AVAILABILITY

We make reasonable efforts to keep the website accurate, secure and available. Occasionally, information may contain errors or the website may be temporarily unavailable.

We may correct errors and update website content when reasonably necessary. If an error materially affects an order you have placed, we will contact you and provide an appropriate solution, which may include cancellation and a full refund.

LIABILITY

Nothing in these Terms limits liability or rights that cannot legally be limited.

To the extent permitted by law, we are not responsible for indirect loss caused by events outside our reasonable control. Any liability relating to a consumer purchase remains subject to applicable consumer-protection laws.

CHANGES TO THESE TERMS

We may update these Terms when our business practices, services or legal obligations change. The updated version will be published on this page with a revised date.

An order will generally be governed by the Terms that were published when the order was placed, unless a change is required by law.

GOVERNING LAW

These Terms are governed by the laws of Victoria and Australia. Nothing in this section removes any mandatory rights you may have under the laws that apply where you live.
